Legal Question in Family Law in Florida

Father has custody Relapsed Fled State

I granted custody to the Father March 2003 from a dependency case. Father has since relapsed on drugs/alcohol, has fled the state of fla with the kids without notice. My wages are being garnished for child support $250 a week. I only make $15 hour. Haven't seen or talked to my kids until they came to visit my parents. I have a visiation order in place every other weekend, etc. Kids tell stories about the Father. DCF contacted. Unfounded. Police have been called. No cause to act. Kids do not want to be with father. My oldest daughter (21) willing to go to court to talk to judge as witness. How do I get before a judge before Aug 1st 2005 when kids go back? Can I bring witnesses to court? What can I file with the county clerk to get emergency hearing? Do I still have to pay child support if not seeing children and father is on drugs? I need advise to fix this quick. Bad situation. What can I do? Can I take the kids to court to talk to Judge without Father consent? If grandparents go while they are here?

Re: Father has custody Relapsed Fled State

You must go to the Court and seek a modification of the prior order. Appropriate papers must be filed.
