father giving up parental rights

i am currently living in florida, originally from n.y. I have been divorced from my childrens father for three years. He was court ordered to pay alimony and child support. He never to this day has paid either. He is currently in jail in N.y. Is there a legal way to have him give up rights to the children? Also how can i go about legally changing the childrens last names?

In Florida, incarceration can be grounds for "abandonment." You would have to petition the court to terminate his parental rights. As for the names, you also petition the court for a name change.
