Does father have right to leave state with out my permission during custody batt

Never married. No custody has been determined however, children always resided w/ me; father for the 1st time ever took girls on vacation and never returned. Father filed for custody and now currently fighting in court. Mediation has happened where we only established more vistitation for me but he has left to Puerto Rico w/ children for over a month. His attorney stated he had informed me and I need to withdraw the motion of contempt (which I filed) if not he will sue me. Is this just a scare tacktect? Most important, can the father just take off? Why isn't this kidnapping?

Until a court determines custody and visitation , he can take them anywhere.
