Legal Question in Family Law in Florida

Father needs legal help!

I'll be as direct as I can here. I'm not wealthy, but was recently ordered by the courts to pay child support, and basically lost the ability to see my daughter. With my bills, low income, and lack of willingness to help on the mother's part, I haven't seen my child in 4 weeks now. I had her 4 nights a week prior to this, and she's about to turn 5. Now, I only get her when the mom says I can, pay nearly $400 (%20 of my income) in child support to a woman who lives for free off her $60,000 a year boyfriend and government assistance, have to drive both ways, pay for health insurance, and basically have no rights with my daughter. If the support was lowered, I might be able to get a car that can make the hour long drive to see my daughter, and be able to afford the gas, or, if I could get the mom to make the drive just as good. I've looked everywhere, fathers rights groups, resource centers, etc, but I don't know where to start. I'm not law savvy, and I really need some simple instructions. I want custody of my daughter back, she needs me in her life. She's a complete daddy's girl, and I can't handle another bedtime phone call where she cries herself to sleep asking why I can't come over. Please help.

Re: Father needs legal help!

It sounds like you were on the receiving end of a Dept of Revenue case on child support, which as you found out, cannot address issues of time sharing. You need to file a petition to determine parental responsibility and time sharing (what used to be known as custody or visitation).

If money is tight, I can help you through a limited appearance by which I only draft the initial pleadings and point you in the right direction. That can cost as little as 500, and you can always hire me for more, if you get stuck.

Call my office on Monday morning, if you are interested.
