Legal Question in Family Law in Florida
My father who passed away a few years ago, setup an utma account for my niece who is now 12 without appointing a successor custodian. My sister who is the minors mother also passed away. I would like to be appointed the successor custodian for this account. how can I do this without going through probate? The account has less than $9,000 in it. this would be in Broward County Florida.

The bank should require that you be appointed guardian of her property by the court. Contact the bank to verify.

You will need guardianship papers.
