Legal Question in Family Law in Florida

A father in prison till october 2015 charged with drug related charges. His son 7 years old has visited his dad with grandmother one day a month for 3 years with the 7 year old boys moms permission. The mother is considering moving from florida to virginii for her boyfriend of 4 months. Does the father inmate have any rights to keep his son in the state of florida?

Is this man married to the mom? If not, he would have to file a paternity case action to establish that he is the father, then he would need to file visitation plan and then if she decided to move then he could file a motion to stop the relocation. I suggest you contact a family law attorney and discuss the matter to see what applies for bio dad/married dad.
