Legal Question in Family Law in Florida

Father won't return son

I need a little more help with a previous question please. I let my son visit his father for the summer in Alabama. I live in Florida. The father now does not want to return my son. I need to know if he legally has any rights to keep him. We have never been married and he is NOT on the birth certificate. We have also never been to court for anything. I can not afford a lawyer and need to do something quick to get my son back. Any advice would be helpful cause I don't know what to do.Thank you.

Re: Father won't return son

You have a couple of problems here. First, it's true that the father has no rights under Florida law. Bigger problem for you, though, is that your son may not be under Florida law anymore. He may now be under Alabama law.

Even bigger problem is this line that you wrote: "I can not afford a lawyer...." You really think you can handle a multistate custody case on your own? Isn't your son worth more than that?

Find the money and go get a lawyer.

Your best bet is to hire a lawyer to file the proper paperwork. Otherwise there is no court order in place to give you any superior rights over the person you are calling the father. Conttact my office for a free consultation.
