Legal Question in Family Law in Florida

I am a father seeking visitation or custody of my 5 year old. I am not on the birth certificate and the mother of my child would not let me be on it. I have had visitation every other weekend and some holidays, and she refused to accept money for me, and agreed that this would stay the same as long as i didnt go to court over custody, until recently and now she refuses me any rights to my son. I have not seen my son in 4 months and she barely will answer my calls to even speak to him. I have picked up the packet from the court house to start the custody battle. Which I know will be a battle instead of just allowing me to see me son. I am willing to do what ever it takes to get to see my son hopefully more than she allowed prior to all of this. What are the best action plans or requests I should make. I know most of the time fathers have a hard time trying to get this. I would like half custody of him, as I feel it is important for a father to be in a childs life. Please let me know what I should do, I feel lost without him.

You need to File a Paternity Petition this establish as your son's father. Through this petition you can request custody, visitation, and establish child support. If you need assistance in filling out the forms you can get help at the Family Court Services office located in your county of residence.
