Legal Question in Family Law in Florida

My fiance of 12 years just passed we have a 4 year old. His parents already creamated him which he didn't want...kinda my fault couldn't think clear. But now they want to spread his ashes & I know he didn't want that...I know he would want his daughter to have at least some of them. Is she legally his next of kin, therefore making it my desicion since I'm her guardian?

You obviously don't get along with the finace's parents. I would ask for a small vile of them. The funeral homes do have small hand sized urns that they could put some ashes in for you. However, it really is up to the parents since you were not married you have no legal say.
