Legal Question in Family Law in Florida

I want to file for divorce, but I cannot afford to move out of the house we own. Are there any pros/cons to staying in the house? How will this work? Do I still have a sherriff serve him the papers? I am unsure how to proceed, or if it will make it worse to just serve him without talking about it. He is hostile, but not physically (he just yells and tells me horrible things), so I dont think I can get a restraining order.. Thanks.

File for divorce and get a Temporary Needs Order in place. That way you get to stay in the house and he has to move out.

Why don't you talk about it and then file the paperwork. If one of you have to move out, it will be more expensive. See if you can deal with it rationally and coalmly first, but if not, then someone will need to go.
