Legal Question in Family Law in Florida

Where do i have to file ?

I have lived in Atlanta,Georgia since 12-1-00. My husband lives in Orlando, Florida. We were married there also.

This is a simplified dissolution of marriage and we both will sign. Can I file in the Fulton County courts here in Atlanta or do they have to be filed in Orange County, Florida?

In the hypothetical presented, if husband will consent to jurisdiction in Fulton, then Fulton can do a full-blown divorce. If not, then Fulton can only adjudicate your "status" as married or unmarried. This assumes that there are no other facts that would support long-arm jurisdiction, such as husband having lived in Georgia during part of the marriage.
