Legal Question in Family Law in Florida
My ex filed a petition to modify permanent periodic alimony.I was looking at the legal forms for financial disclosure, online legal forms.Do I have to put property on there that was in the final judgment?I have property that was in my moms name since 1999,we divorced in 2008.That was on our final judgment that if I ever receive money in anyway that I will have to give him his portion. He said he was going to list that on his financial paperwork, can he do that if the judge already took care of that by saying if exwife ever receives any financial gain from said property,on the final judgment Does the petition to modify only deal with earnings and our financial obligations from the time of the petition?I am confused this is not a divorce, this is a petition 3 years later...HELP!!!!!!!!!!!!!!!!!!!!PLEASE!!!!!!!!!!!!

Your financial affidavit is a snap-shot in time to show your financial situation. You need to fully disclose everything. Keep in mind that you will be signing it under oath.
For a downward modification, he needs to establish that a substantial change in circumstances has occurred, since the issue was last addressed by the Court, and that it was involuntary, and unanticipated.
If you opt to proceed without the assistance of counsel, be aware that you will not be entitled to a do over if things go badly.
