Legal Question in Family Law in Florida

I have a final judgment for paternity and visitation schedule (effective Nov 2009). In the judement the father gets our son every Thur for 3 hrs and every other weekend. The father is not following the orders bringing our son home 1 day late etc, I am filing for contempt. My question is he will try to fight for 50% visitation even though he owns his own business and works many hrs a week and I'm a stay at home mom, our son is 5 years old. Can he switch the visitation from what is current to 50/50?

He can file anything he wants. it is up to you to be able to dispute the change. Get a lawyer, looks like you are dealing with a person who is out to get you and not looking at the best interest of the child.

There is no way to speculate what he may do in the future. In Florida anyone may file anything upon paying the proper filing fee. As far as changing the schedule he cannot do so without going to court and obtaining a new Order; or obtaining your consent.
