How do I fire my attorney and get an extension on the day of my custody hearing?

Send him a letter discharging him. If your are proceeding pro se, make your motion for a continuance to the court explaining your reason therefore. In the alternative, you may retain a new attorney.

Send him/her a certified return receipt requested letter to the attorney stating that you no longer with for him/her to represent you. Be aware that if you owe your attorney any funds, that the attorney will probably not hand over any materials that you need for the hearing. Depending on the date of the hearing for custody hearing, the judge may or may not grant you a continuance. I suggest you go ahead and find another attorney and have the new attorney file a substitution of counsel.
