Legal Question in Family Law in Florida

Fl divorce

I reside in the state of FL. I;m going to get a divorce on the grounds of abandonment. My spouce went back to her home country and I can't reach her. She's been gone for 1 year there is property and children involved. Her child i adopted is with her and a car and house is in both names. How do i file for divorce? She's been out of the US for over 1 year and is unable to reenter the US. What's the easisest way to divorce? I'm claiming everything becuase she can't come here to contest it anyway. I just want my car and my house in my name and no support because the child isn't my blood and she took her without asking.

Re: Fl divorce

For the most part, you can go through standard procedures for dissolution of marriage. You will have to give what is called "constructive service" because she is out of the country. If she doesn't respond/defend, you will probably get what you say you want. If she does respond and contests what you are asking for, you may not. She is entitled to her share of the marital property and the fact that your child is adopted doesn't relieve you of parental responsabilities. However, given what you said, she probably will not respond to the petition.

NOTE: This communication is not intended as and should not be interpreted as legal advice. Rather, it is intended solely as a general discussion of legal principles. You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. By reading the "Response" to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. You need to file a divorce with the appropriate circuit court for the county in which you live. I would suggest you retain an attorney to represent you in order to try to obtain a favorable result.
