Legal Question in Family Law in Florida

FL - never married - moved while pregnant

I was never married and moved when I was 8 months pregnant to another state ( to get support from my family and escape his drug/alcohol/verbal abuse - I had been living alone with no support from babies father).

My baby and I have been living here for only 5 months. I received a summons from FL from the father seeking custody/visitation, etc. I want the case dismissed in FL and moved to the state in which we reside. My baby is only 5 months old, and therefore not a resident of the new state. Also, baby was most likely not conceived in FL, but rather on a trip to a 3rd state.

The father is not on the birth certificate and paternity has not been established. I have sent him a summons from our new state (after I received his summons) seeking proof of paternity which could take several months (at which time the baby will be a resident of the new state).

Will this case most likely be dismissed from FL courts? Why/how or why not?
