Legal Question in Family Law in Florida

in my florida divorce settlement I am to recieve half of my ex-husbands 401k benefit at 63 years of age. Is there a way for me to recieve these benefits sooner. I have medical issues and being able to offord medical help would extend my life. Also if I were to die before age 63 could this money be given to my children? Thank you for this oppertunity. Lisa

Yes and NO. You can have the divorce settlement amended to reflect payment now but if the funds are x amount today, this will not be the amount you probably need at age 63 to continue living. There may or may not be social security or another program in place at that time.

As to your health, if you are in need of medical assistance there are plenty of charity programs at the hospital that will help you get assistance to cure your illness.

as to Children - yes they coud inherit the agreed amount . It must be stated in your decree and in your will.
