Legal Question in Family Law in Florida

Florida Family Law/ Emancipation Law

I am trying for emancipation in Orange County, Florida. Firstly, I have already read Florida Statutes Section 743.015 - Disabilities of nonage; removal. So I know what is required. The complicated part is my mother will not sign for emancipation. As far as I know, my mother has sole guardianship. I have not lived with my mother for over a year and a half. I have recently recived a Child Labor Law Waiver. To help me get this waiver, my mom sent a sign and notarized statement to the Department of Business and Professional Regulation stating that I have not lived with her for over a year and that I am self sufficient. She even signed a paper in May of 2007 giving me permission to marry my longtime boyfriend. Though I know that marrying him would probably be easier to do, I do not feel that I am ready for such a commitment. My mother is moving to Tennessee at the end of this month and it will become harder for me to be seen by doctors, get my license, and enroll in college next month without her being around. Also, if the information helps at all, I am currently 5 months pregnant. I am wanting to know if emancipation is an option considering she will not consent.

Without marriage, you cannot emancipate without parental consent.

I wonder why your mother has Guardianship? She's a parent!

You did not mention your age, you age-out at 18 you know.

If your mom moves to Tenn. then she obviously won't be around to supervise you, but she will be responsible for you until 18. Maybe she might be willing on that basis to consent. You din't mention your dad. You only need one parent to consent, I believe.
