Legal Question in Family Law in Florida

in florida, i know the law used to be that if the parents were never married, the mother automatically obtained custody until otherwise determined by the courts. since then, i have been told that the laws have changed. our son is now 10. i would like to know if our situation could be considered "grandfathered in" since the law was in place when our son was born and we were never married.
