Florida Post Nuptual Agreement

Can a valid and properly prepared post-nuptial agreement be utilized and binding under all circumstances in Florida upon the acquisition of a new form of Income - namely the receipt of annual payments guaranteed to the spouses after the donation of a Property Interest to a properly qualified Educational Institution? Is it established in Florida, that spousal waivers to such a passive property interest in appreciation and consideration of the nature of original acquisition of said property as an unequal factor in equitable distribution, may be covered in a properly prepared post-nuptial agreement?
