Florida vs Virginia

My daughter and my grandaughter live in Virginia, her husband left and moved to Florida several months ago. He has left them twice in one year. He sends no support and pays no bills. Now all of the sudden he wants my granddaughter, do you know how this works? Does he have a leg to stand on? Thank you, Sharon

Hard to say without knowing more but it sounds like your daughter is in a stronger position to be awarded custody, as long as she is a fit parent. He will have to file for custody and then a hearing will be held to determine who should have custody (what would be in the child's best interest).

Without more information one cannot assess the merits of the father's case. That said, abandonment twice in a 12 month period would not be a positive factor. Your daughter should contact a Virginia attorney.
