Forcing a name change...

I am the father of a 3 mo. old child but I don't have physical custody. We both signed the birth certificate and he has my last name. The relationship has unfortunately soured and she told me she wants to change his last name to her last name now.

My question is....can she change it without my consent? She says if I don't agree to sign the name change that she'll take me to court and ask the court to do so? Is it possible that she could get it done that way?
