Legal Question in Family Law in Florida

A friend of mine is going through a divorce. She and her husband have been separated since 2007. We just found out that before the separation, he installed a program on her computer which automatically sent him an update every time she chatted with someone online. He now has over two years worth of private conversations between her and friends.

Is that legal? Even if it is legal, is anything she said in those conversations admissible in a court of law?

Probably not. What happens after 2007 should not make a difference. HOwever, if there is evidence of adultry prior to 2007 and he can prove she used funds from the marriage to support that adultry, then he can ask for the funds back based on infor he retrieved. That's not to say he will get it. It just makes her look bad. Florida only has one ground - irreconcilable differences. Adultry only comes into play when there is lost funds from the marriage.
