Legal Question in Family Law in Florida
i have a friend that is going thru a situatoin with DCF (Department of Children &Families). They have her kids and are threatening her by telling her that she will never get her kids back if she drop domestic violence charges against her kids father . the father has a charge on him against him fos assaulting two agents from DCF. She stated that she doesn't want him to suffer any more than he already has and that he was making changes, going to school, and complying with terms of his probation, but DCF wants him to suffer. Can DCF really keep her kids from her if she does drop charges on her kids dad ?

A court will base its decision on what it considers in the best interests of the children. If the DCFS reason and evidence is credible to the court, the court will act accordingly. Domestic violence is a serious issue; assaulting government agents is a serious issue. Seek advice of an attorney, family aid agency, legal aid organization, or work out a reasonable agreement with DCFS regarding the rights, restrictions, and penalties for the husband over a reasonable period. The court will consider the interests of the children to be most important.
