Legal Question in Family Law in Florida

I have a friend who is 16 yo, biological mom is deceased and bio father is in prison. Her great aunt is her legal guardian. This living arrangement has always been difficult but recently bordering on abusive. There are other relatives that she can live with but her aunt says no. Is my friend old enough to state where she wants to live? Is there any hope for her now, or must she wait until she graduates from high school??

Her aunt is probably receiving income from the state and therefore does not want to lose the income. I suggest you have the 16 year old have whoever is wanting to have guardianship over her to file a Petition with the court for change of guardianship. She will be able to testify at the hearing and if the judge feels the situation is not in her best interest, then he will allow for the change.
