If in front of a judge a parent agrees to the other parent having custody of a child, but then that parent doesnt pay his attorney fees and the order was never drawn up..which parent has custody of the child?

You must abide by the judge's ruling. Unless the judge said (and this would never happen), 'party A gets custody, but if no attorneys fees are paid and no written order is signed, then party B gets custody.' Again, I know that didn't happen.

A parents agreement is irrelevant. It depends on what the judge ruled. If there was a transcript, that will serve as the order.
