Garnishment

Recently, my wages were garnished due to fines associated with child support payments. As my income has decreased substantially, I need every penny I can get just to survive--name removed--How can I get the amount decreased and the garnishment removed? My ex-wife has been approached and will not agree to remove the garnishment.

Nothing can be done as to past moneys owed, but may be done as to future payments that will become due.

If the order is in Virginia where your former wife currently resides, you would need to petition the particular Virginia court which ordered the child support for the decrease in the amount of the support. The removal of the garnishment may be under the control of the state child support enforcement agencies, and, if so, would be unlikely to occur at least until all arrearages owed are paid.
