Gifts as Marital Assets

My wife said she received $40,000 from her father as a gift to her during our marriage. The money was used as part of a down payment for our house. Would this money be a gift and a marital asset to be split upon our divorce?

The answer depends upon which judicial district in which you reside. Some courts recognize this as being a Special Equity, others say it is not.
