Legal Question in Family Law in Florida

hi i have a girl friend with 2 children. Her ex husban called me one day and the convo got really heated. I told him that i was going to kill him and have his children watch. I didn't know that he had recoded it. He is say now a year and half later that he is going to file a restraning order on me for the kids and take time from her. Can he still use this against me in court and what can i do about this bc he kids love me and i love them. I never ment to say the things i said.

Assuming it was illegal to record you (it's illegal to record someone when the recorder is in Florida without telling the person they are being recorded), then the recording can't be used in court, and the person committed a felony by recording you. If the recorder wasn't in Florida , then it's possible the recording could be used against you.
