Legal Question in Family Law in Florida
My girlfriend is going through a divorce.. her husband brought in the majority of their income. Now, she doesn't have the money for an attorney, so her husband keeps pushing off the divorce. She's looking at getting a LOT of money when assets are split because he owns his own businesses... what can she do? There is also a child involved, so child custody would also be an issue.

Have her file for divorce, serve him, and also file with the Petition for Divorce a Motion for Temporary Needs with a Notice of Hearing. The Temporary needs should state she is without funds and looks to him to pay for her attorney and that she needs child support immediately. The temporary needs hearing will probably be held before a magistrate at which time she can appear without representation and ask the court to have him pay her attorney fees along with child support.
She needs a lawyer. If she can't pay and he can, then the court will require him at some point to pay all or part of the attorney fees. This course of action is not even a close call. The way to proceed is to get a lawyer.
