Legal Question in Family Law in Florida

My girlfriend and I are planning on getting married in the near future. She has a seven year old son. The biological father was only around in the childs life for the first few months after birth. Now six and a half years later he has attempted to call for the past few weeks, but only because he's been put in jail again. He has not payed any type of child support in this time. Me and her have been together for two years, and upon marriage would like the child to recieve my last name. She is under the impression that the father will not sign over rights, just so he holds something over her head. We live in florida, and would like to know if this would be a basis for a child abandonment law? Any help is greatly appreciated in advance.

You can have the father's rights terminated and you can adopt the child.
