Legal Question in Family Law in Florida

If me, my girlfriend and my son live together since my sons birth and she took him during the night, do i have any rights? She has a history of drug abuse and is unstable. I have tried to get an emergency hearing to keep her in the county but the judge has not ruled on it yet and she is on the move trying to leave the state. I also called DCF and said there is no proof that the child is in danger. what do i do? HELP

If you've filed for paternity--which I assume you've done since you have filed an emergency motion--you've done all you can aside from hiring a lawyer, which is something you should do immediately. Take heart in that Florida law is very strict about moving kids away from a parent, so if she does move out of state, it's very likely the judge will order the child's return.
