Legal Question in Family Law in Florida
My ex girl-friend took our 2 1/2 year old little girl and left for Michigan about 8 months ago, despite trying to contact her. Unfortunately my name is not on the birth certificate due to doubts in my own mind at the time but watching her grow I became more certain that she was mine. Although before I could put my name on the birth certificate she left and I have no idea what to do, please help me she has done this before and took her away for about a month or so... I am very worried about my little girl and don't have the money for an attorney again any help would be greatly appreciated thank you for your time sincerely, Thomas H. Fischbach

You have to file your case where the child resides--Michigan.
Your girlfriend has established the residency requirement for Michigan. You can file a Paternity Suit there or you can file here and serve her there and have her waive the venue for proceeding. The Petition for Paternity is online in Florida under Florida Family Law Documents. You can read the instructions and try to proceed on your own. The first thing you want is a DNA test to prove whether this is your child and that Petition will instruction you as to how to proceed. If you have no funds, you should have no problem qualifying for a pro bono attorney through a legal aid chapter in your area.
