Legal Question in Family Law in Florida
Good afternoon
I have been married for 10 years to man who has been chronically unemployed with jobs lasting less than 6 months, meanwhile I have a managed to maintain a full time job and come home to cook and clean even though I am disabled.
We do not have any children in common and I would like him to go away. Unfortunately he claims he cannot leave because he will be homeless meanwhile he has his living parents and siblings while I am an orphan and a single mom with nobody to turn.
We moved into one of his parents homes (they have two, one which they live in and one they rented out) because I could not afford to keep paying rent and bills all by myself. The agreement was that we would not need to pay any rent, just maintain the property and pay the rent and bills with living expenses and give them the money for property taxes each year.
I am physically handicapped and not sure how much longer I can continue working myself due to my disability. He is charging left and right but I took my name off all joint credit cards. He has spit, punched and call be vulgar names because of that.
We have many arguments when I have told him I can't continue to live with a man who is happy being a bum while his handicapped wife continues to support us. He is also resentful of my only child for which I do not receive any spousal support due to other parent being in prison.
This is the second marriage for both of us and there is nothing keeping us glued except for the house we live in. I would like to know what legal rights do I have to get out of this situation without having to go into a homeless shelter with my child.
