Grandparent Rights

I have a grandchild living with her mother. My son is her father, and there have been no court ordered visitations or child support since birth of child. Verbal agreement between the parents, only.

My son has fallen behind in support payments. Mom has decided that he will no longer be allowed to see his child until he is payed up. My main question is can the mother also deny my husband and I the right to see our grandchild, also?

A parent can not deny the other parent visitation even if child support is not current. Your son should consider filing his own action (divorce or paternity) to establish his rights and a visitation schedule. Child support will be an issue, therefore, he should pay by check only and keep track of payments made so he will be given credit.
