Grandparent's rights

Hello,

I just have a question for you. My granddaughter is 10 yrs old and has been living with me for about 9 yrs now. There is no custody order in place, and my daughter didn't give me guardianship. She has 2 other children, and wants to now come and get her daughter. Should I just turn her over to her? I don't want to give her up just yet though. I would love to keep her with me. But I feel that I may not have a leg to stand on if she comes to get her. Would the courts have to be involved in this since it has been that long? Or could she just call the cops and have them come and take her? What are my rights? I still want to be a part of my granddaughter's life. I live in Fl.

If your daughter takes "custody" back, your visitation will be up to your daughter. Unfortunately, there are no grandparents' rights in Florida.

If you want to keep "custody," there are a couple of legal avenues you can pursue, but you should speak to a lawyer soon before she takes your granddaughter from you. It's difficult to tell without knowing more about your case whether the police will take your side or hers if she shows up at your house demanding your granddaughter.
