Legal Question in Family Law in Florida
My grandson, age 2 1/2, has been taken care of by me and his other grandmother. The mother has lived out of state off and on for 2 years. She now wants to take the baby out of state, along with her mother. Can I or my son do anything to stop her? She is not a bad parent, and her mother takes good care of my grandson. They were never married and my son has not had to pay child support since we have all "shared" in the responsibilities.

If there is currently no court order in place regarding custody, your son can file a Petition for Paternity, Parental Responsibility, and to Determine Child Support. Within said Petition, your son can file to be the primary residential parent.
IN order to keep the peace, ask them about a visitation schedule. My colleague is correct in her comments. In order to set this in stone in case down the road things change, it is better to have a court order available.
