Can granparents ask for custody of child while mother is in hospital in a persis

#5 year old mother of 2 children hospitalized in vegetative state for 2 weeks after seizures. Present husbannd is not father of oldest child(4 yrs old). Father of child is dexeased. 2 month old baby conceived during present marriage. Can maternal grandparents get custody of grandaughter? Is there anything they must legally do to protect both the child and themselves at present? Does husband have any rights to wifes child?

Grandparents are appropriate people to seek custody. To do so, a petition for guardianship should be filed. Under the

circumstances, a petition for temporary guardianship should also be filed. Custody of the child is determined by the child's

bests interests. The stepfather can also seek guardianship.
