guardianship

my wife died and my stepdaughter is with me. My stepdaughter's father died 7 years ago. I do not have legal guradianship of my stepdaughter. She is 13 years old. What can I do? I have limited funds because I stayed home and cared for my wife 5 years prior to her recent death. My stepdaughter wants to remain with me.

First, my condolences to you on your loss and to your step-daughter who has lost both biological parents at a young age.

The situation you describe needs to be addressed sooner rather than later, and you must do so through the court. You need to petition the court to be appointed as guardian of your step-daughter. This could be accomplished in conjunction with probating your wife's estate.. Did she leave a will which outlined her wishes regarding custody of the child?
