Legal Question in Family Law in Florida

My Ex is getting half of my retirement pay from my 20 years of service. However, she has remarried now, is she still entitled to any of that? It was not ordered in the divorce decree.

Retirement is usually paid by Order of the court. If your decree does not state that, then perhaps you need to have your documents reviewed. Were you separated and allowed for the pay prior to your divorce action? Need more info.

It's not clear why she is getting half of your retirement. Was there a court order that she get half? Based on the facts in your posting, a quick answer to whether or not she is entitled to same the answer is yes she is entitled to same. Unless you have a court order stating otherwise, she is still entitled to the court-ordered portion of your pension.
