Legal Question in Family Law in Florida

How hard is it to obtain temporary guardianship for a child. My ex husband has a child from a previous relationship then we had a child. When we divorced the children got split up and now he wants to give me guardianship but for only about a year. How does this work?

It would depend on the birth mother of the child. If this is not a concern, it would be relatively easy to apply for temporary guardianship.

And what does the birth mother have to say? If custody is the subject of a court order, as is likely, then you will need to get that altered.

There really is no "temporary guardianship" law in Florida, at least not for what you want. If the mother is okay with it, you can just take the child until they decide otherwise. I always recommend that the "temporary guardian" have a power of attorney for nonemergency medical and school purposes. Any family law attorney should be able to help you with that.
