my ex husband, non guardian for our 29 year old disabled son is keeping him from me in another state and calling me with threats of sending him to a residential facility in another state,and offering me money for me to give up legal guardianship. He is also calling my 84 year old mother and doing the same. He has a past felony conviction for the possession and sale of narcotics and served time. I have not been able to get my son back unless I travel to Pinnelis county florida and go before a judge even though I do have lagal guardianship in another state. I am working through the probate court in my state but my ex keeps harrassing me, threatening me and I am afraid for my son. The Sheriffs in his county and the FBI are unable to help me until I can go to that county and go to court. I cannot do that because of financial and health issues at this time. Can I go after him when the probate is taken care for a civil and or criminal action?

You should ask a criminal or civil attorney whether there is a criminal or civil action.

I am surprised the police will not honor the out-of-state guardianship you have. Maybe if that court issues an order enforcing that guardianship -- get advice from an attorney there as well. Hire a guardianship/probate attorney in Florida -- you don't have to be here personally right away, but if you are worried about your son you should do something and maybe DCF will take care of him temporarily. It may not even take long if they accept the out-of-state guardianship. If you are afraid he is being abused in any way, call DCF immediately. If they get involved, you may not need to hire a private attorney, unless they decide you are also unfit.
