Legal Question in Family Law in Florida

Hi. I have.4yr. Old son who. carries the last name of his.father...the biological father is not and has not been in the picture for over 2yrs. What can i do to legally change my sons last name and gain full parental rights without some how trying to search for this man...he has bad habit of being in and out of jail for abuse/theft ect. Recently...last i know he was in jail again. What can i do to gain all rights of my son and where my son can have my last name?

YOu need to petition the court to remove his parental rights.
