Legal Question in Family Law in Florida
Health Insurance on Children
My ex-husband was ordered to keep health insurance on the children but in March that insurance was dropped and he quit his job and moved out of state. I have applied, and received, Healthy Kids for one child and Medicaid for another. I was advised by someone that I could get in trouble for getting insurance on the children since he was ordered too keep it on them. Can I get in trouble for getting insurance on the children when he was ordered to keep it on them even if he has dropped it and has not gotten more?

No but the case should be modified to reflect this change. For further help, please contact our firm for an in person or telephonic consult. Betty Blanco, Esquire
Re: Health Insurance on Children
You won't get in trouble. The kids can't be without insurance.
You should strongly consider filing a motion for contempt against him for dropping the kids from his insurance if he's gotten a new job. If he hasn't gotten a job, file the motion as soon as he does get a job if he doesn't add the kids to the insurance. You'll also need to have the child support modified to show that he is not paying the health insurance and you are paying Healthy Kids. It will increase your support.
