Legal Question in Family Law in Florida

Hi.

I live in Duval County Florida. I need to know the process of modifying/ reopening a child support case. I am not longer working and the mother is getting paid way more than before. The 'ruling' was that my child support payments would go towards health insurance for my daughter. My daughter's mother has her on her company insurance policy. I think not only are my monthly payments too high considering I am not employed and her mother makes way more than me, I am 'paying' for something that is being provided by the mother already. My career is driving. My license is suspended for back payments. I want to try and at least get the payments remodified and/or have the judgement placed on hold, so I can get my driver's license back so I can gain employment.

So long story short, how do I re-open the case? What forms do I file? Can I find the forms online?

You have to petition the court to modify the support which it is recommended that you use a lawyer. Contact my office for free consultation 727-446-7659

Hello: My office has handled numerous modifications of child support. The procedure requires the filing of a Petition to modify. You allege there has been a substantial change in circumstances and briefly mention that change. You file a financial affidavit and you have a process server serve those papers on former spouse/mother. We contact the court and get a hearing date.

If you search for the Fla. Supreme Court website, you can locate the necessary forms if you want to do this by yourself.

If my office can be of any assistance, pls. give us a call. Tom Rosenblum
