Legal Question in Family Law in Florida

Hillsborough County, FL My husband and I filed for divorce in 2006, he was then incarcerated a week before the hearing and still is. The case was closed in Dec 2006 we want to reopen the case and get divorced. How do I reopen the case?

Unfortunately. if the case was closed that long ago, you will most likely have to pay the full filing fee again and prepare a new petition.

You cannot reopen the case. You will be required to file a new case and pay a new filing fee. Best wishes

File a motion to reopen with a $50 filing fee. Hillsborough County judges will allow you to reopen old divorce cases if your intent is to just finish your divorce.
