Legal Question in Family Law in Florida

HIPAA Law / Non-Custodial Parent

I am a non-custodial parent and provide medical insurance coverage for all my children through my employer. My 14 yr old has braces and I agreed to help his mother pay for half of the monthly out-of-pocket fees. They reside in another county. I have contacted the orthodontist office and requested payment history on my son's account to ensure his mother is really paying anything and was told that due to HIPAA Laws, they are unable to give me that information. Is this legal? We actually have no custody order in place. I pay monthly child support and am the insured for the insurance.

Re: HIPAA Law / Non-Custodial Parent

Simply, yes. However, you do have options, You can ask your ex to sign a HIPPA release. This will allow the dentist's office to share information with you.
