home equity

I will be getting a divorce, we have a home that we purchase before getting married that is in my mife's name. however all of the equity in the home is from the increse in value during our marriage. do i get half the accumulated equity during the marriage or she gets it all.

For the period from when you were married until the petition is filed (or sometimes, your separation date), you are entitled to mortgage principal paydown, and any increase in value that has resulted from any improvements made. Though, if a home equity line was incurred during the marriage, that can eliminate a lot of value to your share, since you would be responsible for one half of that debt.
