home ownership

my son is getting a divorce. His wife says for 10,000 she can get an attorney to get her name off the deed which they owe on, and he will have to pay the attorney. the 10000 and still owe the entire cost for the home is this correct? She has a job and makes god money, but is not paying anything of the bills at this time. He will most likley have to file bankruptcy.
