Legal Question in Family Law in Florida

I have a home with my spouse, i want to leave for the safety of myself and children. i want to return after divorce is final. do i need legal paperwork to ensure that my children and i will be able to return back home. if so what is the process.

There is no way to "ensure" that you can return to the home after the divorce is final. For that matter, there is no way to ensure that you will get custody. In fact, most homes are sold as part of a divorce ro some time thereafter because there is usually no way equalize the equity or debt in the home without selling it. All you can do is a file a petition for divorce and ask that you be awarded the home. To increase your odds dramatically, speak with a lawyer.
